Want to place your house in Italy? Here is everything you need to know.

A tiny house in Italy, with your paperwork in order

In Italy the rules for tiny houses are clear: if you live in it, it is a new building and you need a building permit, wheels or not. Here you will find the process, the two real exceptions, and how our houses measure up.

  1. To live inPermesso di costruireeven for a tiny house on wheels
  2. Temporary use180 daysat most, including assembly and dismantling
  3. VAT22 %on a tiny house on wheels; for a permanently placed house see the questions

Consolidated building act, DPR 380/2001

What the law says about tiny houses

The law does not look at the wheels but at the use. Article 3 lists among new buildings the installation of "light structures, including prefabricated ones", including caravans, motorhomes and mobile homes, when they are used as a home or a workplace.

  1. 1What it is in law
  2. 2Which building permit you need

1What it isNew building (art. 3, comma 1, lett. e.5), with or without wheels, unless it serves purely temporary needs
2Building permitPermesso di costruire (the building permit) (art. 10). Alternatively SCIA (a certified notice of the start of works), if the implementation plan or the local zoning plan contains precise rules on layout and volume (art. 23)
Who appliesYou, at the municipality's sportello unico per l'edilizia (the one-stop building desk), with a qualified designer who certifies that the project complies (art. 20)
3Temporary exceptionWorks for short-term, temporary needs, removed within 180 days including assembly and dismantling, with a notice of the start of works to the municipality (art. 6, comma 1, lett. e-bis)
Campsite exceptionMobile homes on already authorised open-air holiday sites, with no permanent connection to the ground and with the features required by regional rules (art. 3, lett. e.5)
EnergyNew minimum requirements from 3 June 2026 (DM 28 ottobre 2025). D.Lgs. 192/2005 excludes detached buildings with a total usable floor area under 50 m² (art. 3, comma 3, lett. d)
Once the work is doneSegnalazione certificata di agibilità (the certified notice that the building is fit for use) within 15 days of finishing the work (art. 24), and registration in the buildings cadastre
TransportUp to 2.55 m wide and 4 m high without special permits (Codice della Strada, art. 61); above that, abnormal load transport
  • The first question is always the plot: the municipality's zoning plan and building regulations say whether a home can be built there, how large and what it should look like.
  • The regions can extend the list of works that need no permit and name other works that need a permit or a SCIA (art. 6, comma 6; art. 10, comma 3; art. 22, comma 4), so the law of your region matters too.
  • In an area protected for its landscape or cultural heritage, you also need the opinion or authorisation of the protection authority (art. 22, comma 6).
  • Always ask your municipality, before ordering, what applies to your plot. The municipality decides, not us.

Our houses

All our houses, measured against the rules

In Italy size does not change the building permit: to live in it you need the permit, whatever the house. It does matter for energy: below 50 m² of usable floor area a detached building is excluded from D.Lgs. 192/2005. Here the area is the external one, length times width; the usable area is a little smaller.

The exclusion below 50 m² concerns D.Lgs. 192/2005; other rules, such as the obligation to use renewable sources in new buildings or the energy rules of some regions, may still apply. Your designer checks this. The mobile models have light insulation (wall about U 0.44), the semi-mobile and non-mobile houses much more. Ask us for drawings and U-values of the model you are interested in.

Frequently asked questions about tiny houses in Italy

If the tiny house has wheels, do I still need a permit?

Yes, if you live in it. DPR 380/2001 also treats caravans, motorhomes and mobile homes used as a home as new buildings. What counts is the use and how long it stays on the land, not the wheels.

Can I keep it on the land for a few months without a permit?

Only for a truly temporary need: art. 6 allows seasonal or temporary works, with a notice to the municipality before you start, to be removed within 180 days including assembly and dismantling. It is not a way to live there permanently.

And on a campsite or in a holiday village?

There the law makes an exception for mobile homes on already authorised open-air holiday sites, if they have no permanent connection to the ground and meet the region's rules. The site operator knows whether your house can go there.

How much VAT do I pay?

For a tiny house on wheels, Italian VAT at 22 %. For a modular home permanently placed and connected, the Agenzia delle Entrate (ruling no. 304 of 5 December 2025) treated it as real property, with different rules and, under certain conditions, reduced rates. Before the contract we check together which scheme applies to your house.

What do you send me for the building application?

Drawings, weights, U-values and the technical documentation your designer needs, free of charge. The sooner you ask us, the easier the conversation with the municipality.

Can I register my residence in the tiny house?

Once the house is authorised and fit for use, it is a home like any other and you can apply to the municipality for residence. Before that step, residence does not replace the building permit.

Can I see a house in person?

We do not have houses to view in Italy yet; the nearest are in Austria and France. You will find all the locations under Viewings. If you need financing, see Financing.
